La Maison MERIT – Sweepstake Terms and Conditions

SPONSOR:

The sweepstake is organized by MERIT Power Beauty Co DBA, Merit Beauty, located at 75 San Vicente Blvd, 8th Floor East, West Hollywood, California 90069 (United States), doing business as MERIT.

TERMS & CONDITIONS:

Registration and participation in the sweepstake imply full and unconditional acceptance of these terms and conditions, which each participant has had the opportunity to consult before registering. The sweepstake is subject to all applicable laws and regulations.

Participation in the sweepstake is open to individuals aged 18 years or older as at the date of entry and residing in France. Employees of Sponsor, and its respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter.

Anyone wishing to participate in the sweepstake must have an email address, go to the following website: https://www.meritbeauty.com/fr-fr/pages/maisonmerit, fill in the required fields with their personal information, accept these terms and conditions by checking the appropriate box, and click the "SIGN UP" button.

Participants are also given the possibility, if they wish, to consent to receive commercial communications from MERIT. This consent is collected via a specific checkbox, separate from the one relating to participation in the sweepstake.

Participation in the sweepstake is completely independent of this consent: entrants may choose to participate in the sweepstake without agreeing to receive commercial marketing messages from MERIT.

The sweepstake will be open from September 2, 2025, to September 9, 2025. Any participation or attempt to participate outside this period will be considered invalid.

Information and contact details provided by the participant must be valid and truthful, otherwise the participant may be excluded from the sweepstake and, if applicable, lose their status as a winner and the benefit of the prize.

Participation in the sweepstake with the same email address is limited to one entry throughout the entire duration of the sweepstake. Although further attempts to participate may be made, only the first complete entry received from the same individual will be taken into account; any additional attempts to participate by the same person, including registrations made under another username, will be disqualified.

Any entries submitted with missing, false, incomplete information, or after the end date of the sweepstake, will be considered null and void. The Sponsor reserves the right to request proof of the authenticity of the information provided by the participant and of their eligibility for the sweepstake.

Participation in the sweepstake is free and without any purchase obligation: buying a product will not increase the participant's chances of winning a prize.

PRIZES:

The prizes that participants in the sweepstake may win are the following:

-       one (1) invitation granting access to La Maison MERIT, located at [La Maison MERIT,  18B Av. Junot, 75018 Paris], on Saturday, September 13, 2025, between 12:00 PM and 6:00 PM (the "Invitation"). Each Invitation permits the winner and one companion of their choice to access the La Maison MERIT store to try the entire MERIT brand product collection, to receive three (3) MERIT brand travel-size products free of charge, and to receive an additional gift if they make purchases with a total value of sixty (60) euros or more during their visit.

Number of Invitations available: sixty (60).

Each Invitation is personal and nominative: access to La Maison MERIT will be strictly limited to the winner and the companion they have designated. The Sponsor reserves the right to refuse entry to La Maison MERIT to any individual who cannot prove their status as a winner or as the winner's companion.

-       Participants who are not selected in the random draw and do not win an Invitation, but who have previously and expressly agreed to receive commercial communications by email from the Sponsor, will receive a promotional code allowing them to receive a gift if they make purchases of Merit brand products on the website https://www.meritbeauty.com/fr-fr (“the Code”) for a total amount equal to or greater than sixty (60) euros. The Code will be sent by email to the address provided by the eligible participants during their contest registration. The email will detail the conditions of use of the Code. The Code will be valid for one week from receipt of the email and can be used at checkout on the website https://www.meritbeauty.com/fr-fr.

Prizes are neither negotiable, exchangeable for cash, transferable, nor assignable, and may only be replaced at the sole discretion of the Sponsor. For clarity, there is no cash alternative for the prize. The Sponsor reserves the right to substitute a prize with another of equal or greater value at their sole discretion. Any incidental expenses not specified in these rules (including, but not limited to, transportation or travel costs to visit the store on the specified date as part of the Invitation) are the sole responsibility of the winner.

PRIZE DRAW:

The winners of the Invitation will be drawn at random by the Sponsor among the participants and will be notified of their win by email. The Sponsor will not be held responsible if a winner does not receive the notifications due to spam filters, “junk mail” folders, or other security or product settings, nor in case of incorrect or non-functional contact details. If the Sponsor is unable to determine and verify a potential winner after several alternate draws, or if there are not enough participants to distribute all available prizes, they reserve the right not to award these prizes.

The sixty (60) winners of the Invitation will be notified by email at the address provided during their registration. They must book, no later than September 11, 2025, using the dedicated link included in the email and among the available slots, a visit time slot for La Maison MERIT on Saturday, September 13, 2025, between 12:00 PM and 6:00 PM.

Acceptance of the Prize constitutes permission for Sponsor to use winner's name and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

ODDS OF WINNING:  The odds of winning this Promotion depend on the number of eligible entries received.

RESPONSIBILITY:

The Sponsor declines all responsibility in the event of a malfunction of the "Internet" network that prevents access to the contest or its proper conduct, or in the case of any potential acts of malice. It is up to each participant to take all appropriate measures to protect their own data and/or software. Any person connecting to the website https://www.meritbeauty.com/fr-fr and participating in the contest does so at their own risk.

In particular, the Sponsor cannot be held responsible for any damage caused to participants, their computer equipment, and the data stored therein, as well as any consequences this may have on their personal or professional activity.

The Sponsor shall not be responsible in the event of an error or omission in the transmission of prizes caused by incorrect information provided by participants, especially an error in the contact email address given.

Without incurring any liability in this respect, the Sponsor reserves the right to cancel, suspend, and/or modify the contest, or any part of it, in the event of force majeure or if fraud, technical failures, or any factor beyond the reasonable control of the Sponsor compromises the integrity or proper functioning of the contest, as decided by the Sponsor. If, for any reason, the sweepstake cannot proceed as planned, the Sponsor reserves the right to disqualify any entry or individual suspected in this sweepstake and any other sweepstake they organize and (a) suspend the contest and modify it to address the issue, then resume the contest in the manner most consistent with the intent of these official rules; and/or (b) award the prizes at random among the eligible and non-suspect entries received up to the moment of the problem.

APPLICABLE LAW AND DISPUTES:

The organization and conduct of the contest, as well as the interpretation of these terms and conditions, are subject to French law, and any dispute arising in connection with the sweepstake shall be submitted to the competent French courts.

PRIVACY:

As a condition of entering the sweepstake, each entrant gives consent for Sponsor, acting as a data controller, to obtain and deliver his or her name and email address and other information to third parties for the purpose of administering this sweepstake and to comply with applicable laws, regulations and rules, including, without limitation, the storing of your personal information for purposes of complying with state record retention requirements. This processing is necessary for fulfilling the contractual terms in these Official Rules and our legitimate interests of compliantly administering this sweepstake.

Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this sweepstake or on a sweepstake winner’s list. Personal information collected from entrants is subject to the Sponsor’s Privacy Policy, which can be found at https://www.meritbeauty.com/pages/privacy-policy.

Subject to obtaining the participant’s specific consent, the information provided may also be used by the Sponsor to send them promotional communications regarding its products and services, including a Code. At any time, each participant has the right to access their personal data, to rectify it, to request its deletion, or to restrict its processing.

Depending on the legal basis for the processing of your personal data, you may also withdraw your consent to the processing of your personal data at any time and you may also object to the processing of your personal data. You may also exercise your right to data portability and exercise any other right permitted by applicable law.

You may also file a complaint before the competent data protection authority (in France, Commission nationale de l'informatique et des libertés).
